Terms of Service

These Terms of Service (“Terms”) govern your use of the Hell Yeah application and related services (the “App”) provided by The Monkeys (“we”, “us”, “our”). By using the App, you agree to these Terms.

1. The service

Hell Yeah is a real-time multiplayer party game for 3–15 players. A host creates a room; other players join with a room code. The App provides prompts, timers, anonymous voting, scoring, and results. The App is provided for entertainment purposes.

2. Eligibility

You must be old enough to use online services in your country. If you are under 18, you should use the App only with permission from a parent or guardian. The App is not intended for children under 13.

3. Accounts and access

The App uses anonymous Firebase Authentication — no email or password sign-up is required. You are responsible for activity on your device while using the App. Do not attempt to bypass security rules, access rooms you were not invited to, or interfere with other players’ games.

4. User content

You may submit display names, avatars, and short text answers during games (“User Content”). You are solely responsible for what you write. You agree not to submit content that is illegal, harassing, hateful, sexually explicit, infringing, or otherwise objectionable.

User Content is shared in real time with other players in your room. We do not pre-moderate answers but may remove access or cooperate with authorities if content violates these Terms or applicable law.

You grant us a limited license to store, transmit, and display your User Content only as needed to operate the game session.

5. Acceptable use

You agree not to:

• Use the App for any unlawful purpose
• Harass, abuse, or impersonate others
• Attempt to reverse engineer, scrape, or overload our systems
• Cheat, automate gameplay, or exploit bugs for unfair advantage
• Circumvent Firebase security rules or room access controls

6. Host responsibilities

If you host a room, you control game settings and may end the session for all players. Deleting a room removes associated game data from our servers. Hosts should ensure players in their room consent to participate.

7. Availability and changes

We strive to keep the App available but do not guarantee uninterrupted service. Games depend on internet connectivity and third-party Firebase infrastructure. We may modify, suspend, or discontinue features at any time.

8. Intellectual property

The App, including its design, prompts, branding, code, and assets, is owned by The Monkeys or its licensors. These Terms do not grant you any rights to our trademarks or content except limited use of the App as intended.

9. Disclaimer of warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE MONKEYS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM (OR INR 1,000 IF YOU USE THE FREE APP).

11. Termination

You may stop using the App at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the App. Provisions that by their nature should survive (including disclaimers and limitations of liability) will survive termination.

12. Privacy

Our collection and use of information is described in our Privacy Policy, which is incorporated into these Terms by reference.

13. Governing law

These Terms are governed by the laws of India. Courts in Bengaluru, Karnataka shall have exclusive jurisdiction over disputes, subject to applicable consumer protection laws in your jurisdiction.

14. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date will reflect the latest version. Continued use after changes constitutes acceptance of the revised Terms.
